Atienza was tagged in the killing of Sto. Tomas town Councilor Adolfo Malipol in Brgy. San Felix, Sto.Tomas, Batangas last January 25, 2009.

Authorities also claim that Atienza led the "Ceferino Dimas" gun-for-hire group that is allegedly behind killings in Sto. Tomas and neighboring towns such as Alaminos and San Pablo City in Laguna.

Armed with a warrant of arrest issued by Judge Arcadio I. Manigbas of RTC, Branch 6, Tanauan City, Batangas, elements of the CIDG-Batangas and the Philippine Navy swooped down at the group's alleged hide-out in Barangay Santisimo Rosario, San Pablo City and arrested Atienza at around 3:45 am.

Assorted ammunition and a subversive document were also seized from the suspect.

Atienza's group was also allegedly involved in the killings of Municipal Councilor Dy of San Pablo City, Laguna in 2007 and a certain "Bautista" in Santisimo Rosario, San Pablo City in 2005, according to police.

Last January 25, 2009, Malipol and 2 village watchmen from San Pablo City were killed when they figured in a heated traffic altercation in Barangay San Felix, Sto. Tomas town in Batangas.

Police identified the watchmen as Arcadio Mendoza and Teodoro Ramos of Barangay Santisimo Rosario in San Pablo, Laguna.

According to police, Malipol was driving along the highway of the barangay when he nearly collided with a barangay mobile patrol of Barangay Santisimo Rosario at around 3:30 pm.

A heated argument then ensued, until one of them, supposedly Atienza, pulled a gun and shot Malipol in his stomach before escaping towards Alaminos, Laguna.

Malipol was rushed to a hospital where he later died.

Police chased the suspects until the barangay patrol rammed into an incoming passenger jeepney along the highway in Barangay San Andres.

Due to the strong impact, watchmen Arcadio Mendoza and Teodoro Ramos died instantly while Barangay Santisimo Rosario councilor Jimmy Corales and barangay tanod Rodante Mendoza were wounded and rushed to Pagmutang Panlalawigan ng Laguna and the Philippine General Hospital.
